Terms and Conditions Team Rockstars IT – Events

Article 1 – Definitions.

  1. Organizer: the private company Team Rockstars IT (hereinafter referred to as Organizer), responsible for the organization of business events, festivals, (tech) conferences and tournaments.
  2. Event: any event organized by the Organizer (one-day or multi-day, indoor or outdoor) including, but not limited to, business events, festivals, conferences or (e-sports) tournaments.
  3. Visitor: any natural person who purchases an admission ticket (Ticket) for, or attends an Event, not acting in the exercise of a profession or business.
  4. Ticket (admission ticket): a proof (digital or physical, provided with e.g. barcode or QR code) that entitles the Visitor to admission to the Event. A Ticket is issued once and is valid for one person.

Article 2 – Applicability.

  1. These General Terms and Conditions apply to every offer, sale and delivery of Tickets and to every (legal) relationship between the Organizer and the Visitor in connection with attending an Event. By purchasing a Ticket or entering the location of the Event, the Visitor agrees to these General Terms and Conditions.
  2. In addition to these conditions, any house rules of the Organizer or the venue, or additional specific conditions per Event, may apply. Such rules will be made known in good time (for example, on the website of the Organizer or at the entrance to the Event). In the event of a conflict, the provisions of these General Conditions shall prevail, unless expressly stated otherwise.

Article 3 – Tickets, purchase and cancellation by Visitor

  1. Ticket Validity: Entry to the Event is obtained only upon presentation of a valid and undamaged Ticket. The Ticket is valid only for the date(s) and the Event as stated thereon and gives access once to one person. Upon leaving the Event (or its location), the Ticket loses its validity, unless otherwise indicated on the Ticket.
  2. Official Sales: Only the purchase of Tickets through the Organizer or official (pre)sales addresses or ticket platforms designated by the Organizer guarantees the validity of the Ticket. The burden of proof of this rests with the Visitor. Tickets remain the property of the Organizer. Once the Ticket has been issued to the Visitor, the Visitor bears the risk of loss, theft, damage or misuse of the Ticket – in principle, no replacement Ticket will be issued in the event of loss. Copying or counterfeiting of Tickets is prohibited; if fraud or counterfeiting is suspected, the Organizer is entitled to refuse entry without any compensation.
  3. Termination of Purchase/Cancellation by Visitor: Tickets once purchased may be cancelled by the Visitor. Cancellations must be made in writing at events@teamrockstars.nl. The following rules apply:

    • Up to 30 days before the event: full refund of the ticket amount paid.
    • Between 30 and 14 days before start: 50% refund of ticket amount.
    • Within 14 days prior to commencement: no refund, regardless of the reason for cancellation. The purchase of Tickets is subject to the statutory exception provision of Article 6:230p paragraph 1 sub e of the Civil Code (exception to the right of withdrawal for time-bound leisure products), which means that the Visitor is not entitled to free cancellation within 14 days.
  4. Personalization & Personalization: Unless otherwise expressly authorized by the Organizer, a Ticket is for the personal access of the Visitor only. The Organizer may decide to sell Tickets by name (personalized), in which case the Ticket is strictly personal and not transferable. Only the person in whose name the Ticket is registered will be granted entry upon presentation of a valid identification document corresponding to that name. The Organizer is entitled to check the identity of the Ticket holder and refuse entry if it does not correspond to the name on the Ticket.
  5. Maximum number and orders cancelled by Organizer: The Organizer reserves the right to impose a maximum on the number of Tickets to be ordered per person. The Visitor is obliged to comply with this maximum. If exceeded, the Organizer may without further notice cancel the additional Tickets or the entire order and invalidate the corresponding Tickets. In such a case, the Visitor – insofar as the original payment had already been made – is entitled to a refund of the price of the cancelled extra Tickets (excluding any service charges).

Article 4 – Prohibition of resale and transfer of Tickets

  1. Prohibition of Commercial Resale: The Visitor is prohibited from reselling, renting, auctioning, giving away Tickets in any way for promotional purposes, or otherwise providing them to third parties for commercial purposes. Nor may a Ticket be offered for sale through any (online) public advertisement or platform, unless through the Organizer’s designated ticket resale platform (if available). Resale or transfer exclusively within the private sphere (for example, passing a Ticket on to an acquaintance at cost price) is permitted only insofar as this does not conflict with the other provisions of these Terms and Conditions (such as personalization requirements or use of an official resale platform).
  2. Official resale platforms: if the Organizer designates an official resale platform authorized by the Organizer (e.g. a ticket exchange or secondary market recognized by the Organizer), the Visitor may offer his Ticket for resale exclusively through that platform. (Re)selling Tickets through unauthorized channels is expressly prohibited. The Organizer may refuse entry to a Visitor who holds a Ticket obtained through an unauthorized channel. The Organizer accepts no liability for the validity of Tickets obtained through unofficial channels, nor any damage suffered by the Visitor as a result of purchasing a Ticket through a channel not authorized by the Organizer.
  3. Transfer under conditions: If a Visitor makes a Ticket available to a third party (e.g. an introductee), he is obliged to inform the third party of the same obligations and conditions that apply to him as a Visitor under these General Terms and Conditions. The Visitor guarantees to the Organizer that that third party will comply with all obligations. The transfer of a Ticket (for non-commercial purposes) does not relieve the original Visitor of his responsibilities to the Organizer.
  4. Measures in the event of violation: In the event of violation of the above prohibitions or failure to guarantee them, the Visitor will owe the Organizer an immediate fine of €10,000 (in words: ten thousand euros) per violation, plus €5,000 (in words: five thousand euros) for each day (or part thereof) that the violation continues. This is without prejudice to the right of the Organizer to additionally claim fulfillment and/or additional damages if the actual damages suffered are higher.
  5. Invalidated Ticket: In the event of (suspected) violation of the provisions mentioned in this article, the Organizer is entitled to immediately invalidate the Ticket concerned and refuse (further) entry to the Event for the holder of that Ticket, without the Visitor or holder being able to claim a refund of the paid ticket amount or any other compensation. Holders of invalidated Tickets are not entitled to admission, refund or any other compensation, and the Organizer is entitled to confiscate such invalidated Tickets.

Article 5 – Access to the event and code of conduct

  1. Entry requirements and identification: A Visitor has access to the Event only upon presentation of a valid Ticket (see also Article 3.1) and, if requested by the Organizer, a valid identification document to verify age or identity. The Visitor must retain the Ticket during their stay at the Event and present it upon request by the Organizer, its staff, security personnel and/or other authorized persons. If specific age limits apply to an Event (e.g. 18+), this will be announced in advance; Visitors who do not meet the minimum age will be refused entry, without the right to a refund.
  2. Checking and searching: The Organizer and security personnel have the right to check and search Visitors and their luggage for prohibited or dangerous items prior to or during the Event. The Visitor consents to such security checks. If a Visitor refuses to cooperate with checks or searches, he may be denied (further) entry to the Event or may be removed from the premises, without any right to a refund of the Ticket.
  3. Prohibited Items and Resources: The Visitor is prohibited from bringing or possessing certain objects or substances at the location of the Event. This includes in any case (non-exhaustive) weapons and sharp objects, explosives and fireworks, (soft and hard) drugs and illegal narcotics, laughing gas (cartridges/bottles), own alcoholic beverages or drugs, glassware or cans, dangerous substances, (domestic) animals (with the exception of guide or assistance dogs) , drones, professional photographic, film or recording equipment (unless expressly permitted by the Organizer) , laser pens, large flags/sticks, and other objects that in the judgment of the Organizer may pose a safety risk or disrupt the event . Nor is it permitted to bring your own food and (alcoholic) beverages, unless expressly permitted by the Organizer. The Organizer or security personnel may confiscate prohibited items; confiscated items will not be returned and, where applicable, may be turned over to the police.
  4. Order and Directions: The Visitor must at all times comply with the house rules of the Organizer and/or the location, as well as all reasonable regulations and instructions of the Organizer, the operator of the location, the security and service team and other authorized persons. Instructions by staff aimed at order, (fire) safety and smooth passage must be followed to the letter. For example, it is not permitted to enter closed or exclusive areas (such as stage, backstage, technical or staff areas) without permission.
  5. Conduct and Order: Entering the Event Location and attending the Event shall be conducted in an orderly manner. The Visitor must behave in accordance with public order and decency. Engaging in discriminatory, intimidating, aggressive or otherwise annoying acts or statements is prohibited. Likewise, the wearing of clothing, symbols, flags or signs that the Organizer deems offensive (e.g. insulting, discriminatory or inflammatory), or that do not comply with any dress code announced by the Organizer, is not permitted. The Organizer or security has the right to refuse Visitors with such behavior or clothing (further) access or to remove them from the premises.
  6. Measures in the event of violation: The Organiser reserves the right, if a Visitor acts in violation of these General Terms and Conditions, the house rules or otherwise disrupts the order, safety or progress of the Event, to deny this Visitor (further) access to the Event or to immediately remove (or have removed) the Visitor from the site. This also applies if a Visitor is evidently under the influence of alcohol or drugs and therefore causes or threatens to cause a disturbance. The Organiser may call in the assistance of the police if necessary. In all these cases, the Visitor is not entitled to a refund of the Ticket or any other form of compensation for missed parts of the Event. Any damage caused by the Visitor will be recovered from the Visitor.
  7. Smoking Policy: Unless otherwise indicated by the Organizer, smoking (including the use of e-cigarettes or other electronic smoking devices) is not permitted inside venues, tents, buildings or indoor locations of the Event. Smoking is permitted only in any designated smoking areas or outdoor areas. Violation of the smoking ban may result in the violator being removed from the premises, without entitlement to a refund, and a fine or other penalty may be imposed in accordance with the venue’s smoking policy, if any.

Article 6 – Modification, cancellation and force majeure (Organizer’s policy)

  1. Force majeure and right to cancel/reschedule: The Organiser has the right to cancel, postpone or move an Event to another date and/or location in the event of force majeure in the broadest sense of the word . Force majeure includes any circumstance beyond the control of the Organizer as a result of which fulfillment of the agreement cannot reasonably be required of the Organizer, including (but not limited to) extreme weather conditions, pandemics/epidemics, government measures, fire, terrorist threats, strikes, war, disasters, as well as illness or cancellation of artists/speakers or failure to obtain permits in a timely manner. The Organizer may also decide to cancel or reschedule in case of other calamities that may affect the safety or success of the Event.
  2. Total cancellation prior to commencement: If the Event is cancelled in its entirety by the Organizer prior to commencement (e.g. due to force majeure), the Visitor – only if the Ticket was obtained through the Organizer or an official (advance) sales address – is entitled to a refund of the ticket price (i.e. the amount stated on the Ticket or the nominal price paid through the official sales channel). Any service charges or transaction costs will in principle not be refunded, unless the Organizer decides otherwise. Travel, accommodation and/or other indirect costs already incurred will also not be reimbursed. The Organizer will announce the cancellation as soon as possible on its website and/or via the Ticket Buyer’s contact details, including the procedure and period within which a refund can be requested. Refunds will be made only upon request of the original Ticket Buyer and, to the extent required, upon presentation or validation of a valid and undamaged Ticket. If the Ticket was obtained through an unofficial channel, the Organizer has the right to reimburse only the original purchaser; a holder who obtained the Ticket from a third party will have to contact that third party (original purchaser) for a refund.
  3. Partial cancellation/cancellation during Event: If the Event has to be cancelled early or partially cancelled after its commencement due to or in connection with force majeure, the Organizer may decide on a reasonable partial compensation. In that case, the Organizer will refund – in a fair and proportionate manner – a portion of the ticket price to be determined by the Organizer to the original purchaser. Service charges and other indirect costs will also not be reimbursed in this case. The Organizer will endeavor to inform the Visitor of this within a reasonable period of time after the date of the cancelled Event.
  4. Relocation/date change: If an Event is moved to another date and/or location (e.g. due to force majeure), the purchased Tickets will in principle remain valid for the new date/location. The Organizer will inform the Visitors about this as soon as possible (e.g. via the official website, e-mail or the sales partner) and indicate within which period and in which way a possible refund can be requested. If a Visitor is unable to attend on the new date, only the original Ticket Buyer has the right to request a refund of the ticket price (excluding service charges) within the response period set by the Organizer. After the expiration of that period or on the day of the replacement Event, the right to a refund will expire and the Ticket will remain valid for the replacement date. Any resale outside official channels remains at the Visitor’s risk; the Organizer may choose to communicate with and reimburse the original purchaser only.
  5. No further liability or compensation: In the event of cancellation or relocation as referred to in this article, the Organizer shall not be liable for any further costs or damages incurred by the Visitor, such as – but not limited to – travel and accommodation expenses, cancellation costs, or any other indirect or consequential damages. The Visitor may also not claim an alternative ticket to another event as compensation, unless the Organizer itself offers this out of courtesy. The aforementioned right to a refund of the ticket price constitutes the sole and full compensation. Any other form of compensation due to cancellation or modification is also excluded (see also article 7 on liability).
  6. Changes in program/line-up: The Organizer shall make every effort to run the Event in accordance with the announced program and schedule. However, the Organizer reserves the right to make changes to the program, line-up (performing artists/speakers), layout of the Event and start times. Indicated start and end times of the Event, as well as published programming, are indicative and may be subject to change. Such changes, deviations in the timetable or the non-appearance of certain announced artists/speakers do not entitle the Visitor to a refund of (part of) the Ticket Price or other compensation, as long as the Event is essentially going ahead. The Organizer is not liable for any resulting damages, including disappointment of the Visitor. It is the responsibility of the Visitor to check the Organizer’s communication channels (such as the website or app) shortly before and during the Event for any updates in program or schedule.

Article 7 – Liability of the Organizer

  1. General / own risk: Entering the Event Location and attending the Event is entirely at the Visitor’s own risk. The Organizer, the Venue Owner and third parties engaged by them accept no liability for any injury, material and immaterial damage or loss (including hearing, sight and other physical damage) that the Visitor may suffer during the journey to and from, the stay at the Venue or attending the Event, unless such damage is the direct result of an intentional act or gross negligence attributable to the Organizer.
  2. Limited liability Organizer: Should the Organizer be liable to the Visitor, such liability will at all times be limited to direct damage suffered by the Visitor as a result of an attributable shortcoming on the part of the Organizer. Eligible for compensation are only those direct damages for which the Organizer is insured and which are reimbursed by the insurer. Moreover, the Organizer’s liability is always maximized to the amount paid out in the case in question by the Organizer’s liability insurer.
  3. Exclusion of consequential damages, etc.: Not eligible for compensation are (to the extent permitted by law) all indirect damages, consequential damages and immaterial damages of the Visitor, including, inter alia, lost profits, missed savings, reputational damage and damage due to business stagnation. Damage claims by the Visitor on account of criminal acts of third parties, or other non-direct causes of damage, are expressly excluded.
  4. Damage by third parties / auxiliary persons: The Organiser is not liable for acts or omissions of third parties involved in the implementation of the Event, such as suppliers, artists, speakers, operators of the venue, security firms and the like, insofar as these are independent contracting parties of the Organiser. Any liability for conduct of (non-)subordinates or auxiliary persons within the meaning of Article 6:170, 6:171 and 6:172 of the Dutch Civil Code is excluded. Furthermore, the Organizer is not liable for damage or loss caused by non-compliance by third parties (such as transport companies, catering operators, etc.) of their obligations.
  5. Personal Property: The Visitor is responsible for their own personal property during the Event. The Organizer and the venue facilities (e.g. cloakroom/vaults) accept no liability for loss, theft or damage to the property of Visitors, unless the damage is the direct result of intent or gross negligence on the part of the Organizer. The Visitor is advised not to leave valuables unattended.
  6. Reporting damage: Should the Visitor experience damage during the Event which he believes to be attributable to the Organizer, he must report this in writing to the Organizer as soon as possible, preferably within 48 hours after the occurrence of the damage or the end of the Event, clearly describing the damage. Failure to report on time may result in the lapse of any claim against the Organiser in respect of that damage, unless the Visitor can demonstrate that timely reporting was not reasonably possible under the circumstances.
  7. Liability and Obligations Visitor: The Visitor is liable for all damage caused by him during his presence at the Event to persons (including staff, other visitors) or property (including the location, fixtures, equipment, etc.). If as a result of the Visitor’s acts or omissions the Organizer suffers direct or indirect damage or is held liable by third parties, the Visitor shall fully indemnify the Organizer for all resulting costs, damages and claims. This includes reasonable legal costs.
  8. No limitation in case of intentional/ gross negligence: The exclusions and limitations of the Organizer’s liability contained in this article do not apply in case of intentional damage caused by the Organizer himself or conscious recklessness on the part of the Organizer. To the extent that these limitations would not be valid under mandatory law, the other provisions remain in full force and effect.

Article 8 – Privacy and personal data

  1. Processing Personal Data: The Organizer processes personal data of Ticket Buyers and Visitors in accordance with its privacy statement and applicable privacy legislation (including the General Data Protection Regulation – AVG). The Organizer’s privacy statement, which explains what data is collected and for what purpose, can be found on the Team Rockstars IT website. By purchasing a Ticket and/or attending the Event, the Visitor grants permission for these processing operations to the extent necessary.
  2. Purposes: Personal data is used, among other things, for the processing of ticket orders, access control, the improvement of services and – if the Visitor gives separate consent – for providing information about (future) events and marketing purposes. The Organizer takes appropriate technical and organizational measures to protect personal data.
  3. Third parties and visual material: When attending the Event, visual and sound recordings may be made (see Article 9). Insofar as personal data of Visitors are visible thereon, these recordings will also be processed within the meaning of the law. When disclosing such recordings (for example for promotional purposes), the Organizer will take into account the reasonable interests of those involved and any applicable laws.

Article 9 – Intellectual property, photographic and video recordings

  1. Rights of Organizer and artists: All intellectual property rights relating to the Event and parts thereof belong to the Organizer or its licensors (such as artists or speakers). This includes trademarks, trade names, logos of Team Rockstars IT and the Event, as well as the content of performances, presentations, images and music at the Event. The Ticket only grants the Visitor the right to attend the Event; it is expressly forbidden to reproduce, publish or commercially exploit any part of the Event (images, audio, brands, content) without the consent of the rights holders.
  2. Prohibition of professional recordings by Visitors: Visitors are not permitted to bring professional and/or commercially intended photographic, film, drone, sound or other recording equipment to the Event or make such recordings without the prior express written consent of the Organizer. Nor is it permitted (whether during or after the Event) to professionally distribute, broadcast (live stream) or otherwise commercially exploit image or sound material from the Event without permission. Such action may be grounds for confiscation of the material and equipment, exclusion from (further) access, and/or legal action for violation of intellectual property rights.
  3. Recordings for private use: The taking of photographs, videos and audio recordings with non-professional equipment (e.g. with a smartphone) is generally permitted, provided that it is for the private use of the Visitor only. Any form of publication or use of such material outside the private sphere – in particular commercial or large-scale publication (offline or online) – is strictly prohibited without the prior consent of the Organizer. The Organizer may request the removal of publications on social media or elsewhere if they violate this article or harm the reasonable interests of the Organizer or others involved.
  4. Image and audio recordings by Organizer: By entering the Event, the Visitor expressly agrees that the Organizer, parties affiliated with the Organizer and/or (news or media) partners may make photo, audio and video recordings during the Event, in which the Visitor may appear recognizably in image or sound. The Organizer and the artists have the right to reproduce these recordings, make them public and use them for promotional purposes, reporting and atmospheric impressions, via any media whatsoever, without the Visitor being able to claim compensation for this. The Visitor grants unconditional permission for this and, to the extent permitted by law, waives any portrait rights or other (intellectual property) rights that he could assert on the recordings. The Visitor also transfers any such rights to the Organizer in advance, without compensation. If such a prior transfer is not legally valid in full, the Visitor will cooperate, if requested, to still transfer his rights for no consideration or agree to the use.
  5. Third Party Use: Without express permission from the Organizer, it is not permitted to use or distribute trademarks, logos, program booklets, posters and other protected material of the Organizer or the Event. Press and media must accredit themselves in advance and are also bound by the conditions set by the Organizer.

Article 10 – Final provisions

  1. Amendments: The Organizer is authorized to unilaterally amend these Terms and Conditions. Amended conditions will come into force at the announced time. Amendments do not affect agreements already concluded (Tickets purchased before the amendment date remain subject to the old conditions), unless the Visitor expressly agrees to the new conditions.
  2. Nullity: If one or more provisions of these General Terms and Conditions should at any time prove to be wholly or partly void or voidable, the other provisions of these terms and conditions will remain in full force. The Organizer and Visitor will then consult to agree new provisions to replace the void/annulled provisions, taking into account as much as possible the purpose and meaning of the original provision.
  3. Applicable law and choice of forum: These General Terms and Conditions, the purchase of Tickets and the agreement between the Visitor and the Organizer are exclusively governed by Dutch law. Any disputes arising herefrom or related thereto will be submitted exclusively to the competent court in the district where the Organizer has its registered office (unless another competent court is prescribed by mandatory law) .
